Kinds of Donation

  1. Donation inter vivos – one made between living persons and which is perfected from the moment the donor knows the acceptance of donation by the donee.
  2. Donation mortis causa – one which takes effect upon the death of donor. It partakes the nature of testamentary succession and is equivalent to a transfer in contemplation of death. It is therefore subject to estate tax and not gift tax.
